New York Pharmacy Registration: Key Compliance Requirements

New York Board of Pharmacy imposes strict operational requirements for obtaining and maintaining pharmacy registrations. A pharmacy’s failure to comply with those requirements could result in an enforcement action.

Key Requirements for Registration and Operation

The following are some key registration and operational requirements that New York pharmacies must comply with:

Location Specific. Registration certificates are address‑specific. Relocation requires State Board of Pharmacy (“Board”) approval at least 30 days in advance.

Reporting Corporate Changes. The Board must be notified within 30 days of any change in the officers of the corporation or in stockholders holding 10 percent or more of the stock in the pharmacy corporation.

Damage to Premises. Registrants must notify the Board within a period of 48 hours whenever any establishment registered by the Board is damaged by fire, flood or other disaster.

Sanitary Conditions. Registered pharmacy establishment must be equipped with proper sanitary appliances and kept in a clean and orderly manner.

Signage. Unless an exception applies, establishments must display proper signage on the exterior of the premises in which a registered establishment is located, or in the directory and on the immediate entrance to the registered establishment if it is located in a multi-tenanted structure.

Pharmacies must also comply with numerous other regulatory requirements, including those governing electronic prescribing, prescription transfers, facility and equipment standards, and patient counseling, among others.
